2. About RSC
Red Stub Club (RSC) is a private, members-only community, owned and operated by Peppo, offering curated access to Events in India and internationally. Membership of RSC is granted at the sole discretion of RSC, it is not a matter of right, and is subject to application, eligibility screening, and approval. RSC acts principally as a curator, facilitator, and concierge that sources and arranges access to Events, tickets, Vouchers, and Partner privileges for its Members in accordance with the Membership Plan.
3. Acceptance of Terms
- 3.1These Terms constitute a legally binding agreement between you and RSC. By becoming a Member, you confirm that you have read, understood, and agree to be bound by these Terms, and any Event or Partner specific terms notified to you.
- 3.2These Terms also apply to a Nominee or Guest who attends an Event through RSC, to the extent the provisions relate to them. The Member must make sure that each Nominee and Guest is aware of these Terms before attending an Event.
- 3.3RSC may revise these Terms, the Membership Plans, Benefits, and pricing from time to time to reflect changes in its offerings, Partner arrangements, legal or regulatory requirements, or operational needs and RSC may notify you on the same. Continued use of membership after the amendment of the Terms constitutes your acceptance. A revision that is material (including any change that adversely affects your Benefits or rights, or the purposes for which your personal data is processed) will apply to you only after you give your specific consent through a clear affirmative action, such as clicking “I Agree” in the App. If you do not consent to a material revision, the existing Terms will continue to apply to you until the end of your then-current Membership Tenure. Continued use of your membership is not, on its own, consent to a material revision.
- 3.4Your use of the RSC App is also governed by the RSC App Terms & Conditions. If there is any inconsistency, these Terms prevail in relation to your membership, Benefits, fees and access to Events, and the RSC App Terms & Conditions prevail in relation to your use of the App. Where the Membership Plan sets out a plan-specific Benefit, fee or condition, the Membership Plan prevails over these Terms to that extent.
4. Eligibility and Application
- 4.1Membership is open to individuals who are at least eighteen (18) years of age.
- 4.2RSC reserves the right, at its sole and absolute discretion, to accept or decline any membership application without assigning any reason, and, with your separate and specific consent for this purpose, to conduct such verification, background, or KYC checks as it considers appropriate prior to approval, and RSC may decline an application where that consent is not given.
- 4.3RSC may introduce, modify, discontinue, or re-price Membership Plans at its discretion, without affecting the entitlements of Members already enrolled for their then-current Membership Tenure.
- 4.4You represent and warrant that all information provided during the application process (including identity, contact, payment, or Nominee/Guest details) is true, accurate, and current, and you undertake to promptly notify RSC of any change.
5. Membership
- 5.1RSC currently offers three Membership Plans: Merlot, Merlot Unlimited and Red Access. Each Membership Plan runs for a Membership Tenure of twelve (12) months from the date of activation. Membership is not a lifetime membership and ends on expiry of the Membership Tenure unless renewed under clause 7. The Membership Fee and full details of each Membership Plan are set out in the Membership Plan.
- 5.2RSC may, at its sole discretion, offer additional or bespoke membership plans to select individuals, on terms communicated in a separate offer letter or written confirmation to that individual. Any such plan shall be governed by these Terms except to the extent expressly and specifically varied by that separate offer letter. A bespoke plan takes effect only after the individual expressly accepts the offer letter in writing (including electronically) and, where the plan involves processing personal data beyond what these Terms and the Privacy Policy cover, gives separate consent for that processing.
- 5.3If the Membership Plan permits, the Member may register one (1) Nominee at the time of onboarding, or a Member can buy membership and have two (2) Nominees for membership, in which case only the two (2) Nominees will be able to avail access to the RSC App and not the Member.
- 5.4A Nominee may share in the Member’s ongoing Benefits as described in the Membership Plan. A Nominee is not a Member and holds no independent rights over the membership.
6. Membership Fee, Booking Fees, Payment and Taxes
- 6.1The Membership Fee is payable in full, upfront, through the payment mode(s) designated by RSC, including through a Payment Link. Membership is activated only upon receipt of cleared, full payment. The Membership Fee covers one Membership Tenure of 12 (twelve) months. A booking or ticket shall be treated as confirmed only once RSC has verified receipt of payment, where payment is required for it.
- 6.2All amounts payable to RSC are exclusive of applicable GST, taxes and other statutory levies or duties, and any other charges expressly stated in the Membership Plan, which shall be charged additionally at the rate prevailing at the time of invoicing and reflected in the tax invoice issued to the Member. A tax invoice will be issued for the Membership Fee and for all amounts paid through the membership, in compliance with prevailing tax rules and regulations.
- 6.3RSC reserves the right to revise pricing of tickets, upgrades, and ancillary services from time to time; the Membership Fee for an active Membership Tenure shall not be increased during that Tenure.
- 6.4The Membership Fee is strictly non-refundable under all circumstances, including voluntary cancellation, non-usage of Benefits, dissatisfaction with an Event, or early termination of membership, except where a refund is mandated by Applicable Law.
- 6.5Payments for a tier upgrade, renewal or paid booking are made through a Payment Link on the RSC App, which directs you to an independent external payment page run by a third-party payment gateway, or through another mode designated by RSC. RSC is not responsible for any failure, delay or charge of a bank, card network or payment gateway.
7. Renewal, Grace Period
- 7.1An RSC representative will typically initiate renewal outreach in accordance with their Membership Plan before the renewal date and will continue to do so till the expiry, to coordinate the renewal process. Renewal of membership is entirely at the sole discretion of RSC after the Member confirms that they wish to renew and is not automatic or guaranteed, and shall be offered only on then prevailing Terms and pricing.
- 7.2Where your Membership Plan includes a grace period, you may renew within that period after expiry (forty-five (45) days for Merlot Unlimited and thirty (30) days for Merlot) and continue to enjoy your Benefits during it. If you do not renew within the grace period, all Benefits lapse. Red Access has no grace period and its Benefits lapse immediately on expiry. Any later enrolment is a new membership application on the then-prevailing terms and pricing.
8. Non-Transferability of Membership
- 8.1RSC membership is a single-user membership. It is strictly personal to the Member and is non-transferable, non-assignable, and may not be sold, gifted, sublicensed, pledged, or otherwise disposed of, whether for consideration or otherwise, except for the limited Nominee facility in accordance with the Membership Plan.
- 8.2Any attempt to transfer membership, or to permit any unregistered third party to systematically avail Benefits in the Member’s stead (including by sharing log-in details, Access Methods, Vouchers or tickets), shall entitle RSC to suspend or terminate the membership without refund.
9. Ticketing, Availability, Cancellations and Refunds
- 9.1The availability of tickets, seating categories, and complimentary entitlements (if applicable) may change from Event to Event. RSC will use reasonable efforts to arrange tickets based on availability at the time of request. RSC does not guarantee the availability of any specific Event tickets, category, or seat.
- 9.2Ticket cancellations and transfers, where offered, are subject to the specific policy applicable to the relevant Event, venue, or organiser and must be requested through the App within the timelines specified for that Event.
- 9.3Each ticket is issued subject to the terms of the organiser, venue and ticketing platform, which may include age limits, seating rules, security checks and re-entry rules.
10. Event Cancellation by Organiser/Venue/BMS
- 10.1 Where an Event is cancelled, postponed, or materially altered by the organiser or venue (i.e., not due to any act or omission of RSC):
- (a)if the relevant ticket (for the Member, Nominee, or a Guest) was booked using Complimentary Credits, RSC shall reinstate the corresponding Complimentary Credits to the Member’s account, reflected on the App; and
- (b)if the Member or Guest made a monetary payment for the ticket (i.e., did not use Complimentary Credits), RSC shall coordinate a refund for the Event by contacting the relevant individual directly to confirm their bank account details and processing the refund to that account.
- (a)
11. Member Guidelines and Code of Conduct
- 11.1RSC maintains a zero-tolerance policy toward rude, abusive, or disrespectful conduct toward RSC staff, venue staff, Partners, artists, or fellow Members.
- 11.2Certain shows and Events have limited capacity and are serviced on a first-come, first-served basis notwithstanding membership tier.
- 11.3Each Event or venue may carry its own rules, terms, and policies (including security, bag, and re-entry policies), which Members and their guests must comply with in addition to these Terms.
- 11.4Any Member found buying, selling, using, possessing, or facilitating illegal drugs, illicit alcohol or other illegal substances at an RSC-facilitated show or Event shall have their membership terminated with immediate effect and without refund, and RSC reserves the right to report such conduct to venue security and/or law enforcement authorities.
12. Partner Benefits, Vouchers, Travel and Third-Party Services
- 12.1Partner Benefits are extended by independent third parties under commercial arrangements with RSC and are subject to each Partner’s own terms, availability, pricing, and capacity, which RSC does not control.
- 12.2RSC is not responsible for the quality, safety, legality, or performance of any product or service supplied by a Partner, an Event organiser, a venue, or any other third party. Your recourse for any deficiency in a third-party product or service lies against that third party, except where RSC has beforehand expressly agreed to accept liability.
- 12.3RSC may add, vary, or discontinue Partner arrangements at any time without prior notice.
13. Suspension and Termination
- 13.1RSC may suspend or terminate a membership, with immediate effect and without refund of the Membership Fee, if a Member: (a) breaches these Terms, the Membership Plan, or any Event/venue-specific rules; (b) provides false, misleading, or incomplete information; (c) engages in conduct prohibited under the Code of Conduct; (d) attempts to illegally transfer membership; (e) engages in fraud, abuse of Benefits, or conduct harmful to RSC, its Partners, staff, or other Members; (f) fails to make payment when due; or (g) misuses the App, any Access Method or any Voucher.
- 13.2RSC may also suspend a Membership or any Benefit while it investigates a suspected breach, with notice of suspension to the defaulting Member.
- 13.3A Member may voluntarily discontinue their membership by 30 days prior written notice to RSC; no refund of the Membership Fee (whether whole or pro-rata) shall be payable on voluntary discontinuation.
- 13.4Upon termination or expiry (including lapse after any applicable grace period), all Benefits, unredeemed Vouchers, Complimentary Credits, and access rights under the App shall cease immediately, any Face Data registrations shall be revoked, and any confirmed but unused complimentary tickets may be cancelled at RSC’s discretion.
- 13.5Clauses 6 (to the extent of fees already paid), 14 (Privacy and Data Protection), 16 (Disclaimers and Limitation of Liability), 15 (Indemnification), 18 (Confidentiality) and 19 (Governing Law and Dispute Resolution), and any other clause which by its nature is meant to continue, shall survive termination or expiry of the membership.
14. Privacy and Data Protection
- 14.1RSC collects and processes personal data only for specified purposes, namely to administer membership, deliver Benefits, personalize recommendations, and communicate with Members. RSC may share necessary personal data with BMS, Partners, venues, Event organisers, Turnstile Providers, payment processors, couriers and service providers strictly for the purpose of fulfilling Benefits, ticketing, delivery of Physical Tickets/Bands, m-Ticket, FR-based entry and support, and shall require such parties to handle such data in accordance with Applicable Law. BMS, Partners and other independent third parties handle personal data under their own privacy notices. RSC’s Privacy Policy explains how RSC handles your personal data and shall be read with Clause 14.
15. Indemnification
- 15.1You agree to indemnify, defend, and hold harmless RSC, its directors, officers, employees, Concierge and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with: (a) your breach of these Terms; (b) your, your Nominee’s, or your Guest’s conduct at any Event; (c) any misuse of the App or your account credentials; (d) any false or misleading information provided by you to RSC; or (e) any Face Data or other personal data of a Nominee or Guest that you provide without that person’s knowledge or consent.
16. Disclaimers and Limitation of Liability
- 16.1RSC is not the organiser of third-party Events and shall not be liable for the cancellation, postponement, rescheduling, or conduct of any such third party Events, or for the acts or omissions of any venue, organiser, artist, Turnstile Provider, or Partner.
- 16.2The aggregate liability of each party to the other arising out of or in connection with these Terms or the membership, whether in contract, tort or otherwise, shall not exceed the Membership Fee attributable to three (3) months of the Membership Tenure in which the claim arose (calculated pro rata on the Membership Fee actually paid for that Membership Tenure). Neither party shall be liable to the other for any indirect, incidental, consequential, special or punitive damages, including (in the case of a Member) loss of enjoyment, loss of opportunity, or travel or accommodation costs incurred in connection with an Event that is cancelled, rescheduled, or for which access could not be arranged.
- 16.3 Nothing in clause 16.2 limits or excludes the liability of either party for:
- (a)fraud, fraudulent misrepresentation or wilful misconduct;
- (b)death or personal injury caused by its gross negligence;
- (c)a breach of its obligations of confidentiality or data protection under these Terms or Applicable Law;
- (d)a wilful or deliberate breach of these Terms;
- (e)any other liability that cannot be excluded or limited under Applicable Law.
- (a)
17. Force Majeure
- 17.1RSC shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disaster, fire, epidemic or pandemic, war, terrorism, civil unrest, governmental action or regulation, strikes, power or internet outages, or failure of BMS, a venue, an organiser, a Turnstile Provider, a Partner, or any other third-party service provider to perform. RSC will use reasonable efforts to notify affected Members and, where appropriate, to arrange alternative Benefits.
18. Confidentiality
- 18.1The Membership Plan, pricing, and any Member-specific communications are confidential and intended solely for the named Member. The Member acknowledges that, in the course of their membership, they may receive or become privy to non-public information relating to RSC and its Members (“Confidential Information”), and agrees to hold all Confidential Information in strict confidence, not to disclose, publish, or circulate it to any third party, and not to use it for any purpose other than availing benefits under these Terms, except where such information is, or becomes, publicly available through no fault of the Member, was already lawfully known to the Member without any obligation of confidence, is required to be disclosed under Applicable Law or a valid order of a court or authority, or is required to be disclosed to the Member’s professional advisers on a confidential basis.
19. Governing Law and Dispute Resolution
- 19.1These Terms shall be governed by, and construed in accordance with, the laws of India.
- 19.2If a dispute is not resolved amicably within thirty (30) days of notice, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed jointly by the parties. If the parties do not agree on the arbitrator within fifteen (15) days of a written request to do so, the arbitrator shall be appointed in accordance with that Act. The seat and venue of arbitration shall be Mumbai, India, and the language of arbitration shall be English. The decision of the arbitrator shall be final and binding.
20. General Provisions
- 20.1Severability: If any provision of these Terms is held invalid or unenforceable by a court or arbitral tribunal of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect.
- 20.2Waiver: No failure or delay by RSC in exercising any right under these Terms shall operate as a waiver of that right, nor shall any single or partial exercise preclude any other or further exercise of that or any other right.
- 20.3Assignment: You may not assign or transfer your rights or obligations under these Terms without RSC’s prior written consent. RSC may assign these Terms in whole or in part, without the Member’s consent.
- 20.4Notices: Notices to RSC shall be sent in writing to the contact details below. Notices to Members may be sent via the App, WhatsApp, SMS, or to the email/contact information provided at registration, and shall be deemed received twenty-four (24) hours after dispatch.

App Terms & Conditions
Please read these App Terms & Conditions carefully before using the RSC mobile application.
By clicking “I Accept” or using the RSC mobile application, you agree to be legally bound by these App Terms & Conditions, which are to be read together with the RSC Terms & Conditions.
1. Definitions and Relationship with the RSC Terms
- 1.1These App Terms & Conditions (“App Terms”) apply to your use of the RSC App and supplement the Terms & Conditions for the RSC Membership (“RSC Terms”). Capitalised terms not defined in these App Terms have the meaning given to them in the RSC Terms.
- 1.2 In these App Terms:
- (a)“Booking Request” means a request submitted through the App or to the Concierge for tickets or access to an Event for a Member, a Nominee or a Guest;
- (b)“Data Fiduciary” means the entity that determines the purpose and means of processing Personal Data. RSC acts as the Data Fiduciary for the processing described in this Notice.
- (c)“Data Principal” means the individual to whom the Personal Data relates. References to “you” and “your” mean the relevant Data Principal.
- (d)“Memories” means the section of the App containing photographs and videos of Events, past Event galleries, the Experiences showcase and Event logistics videos;
- (a)
- 1.3The RSC Terms also apply to your use of the App including, clauses 13 (Suspension and Termination), 15 (Indemnification), 16 (Disclaimers and Limitation of Liability), 17 (Force Majeure), 19 (Governing Law and Dispute Resolution) and 20 (General Provisions) of the RSC Terms apply to these App Terms as if set out in them. RSC may revise these App Terms in the same way as the RSC Terms, as stated in clause 3.3 of the RSC Terms.
- 1.4If there is a conflict, these App Terms prevail for the use of the App, and the RSC Terms prevail for everything else.
- 1.5A Nominee or Guest who uses the App (including a web page shared by RSC for registering Face Data) is also bound by these App Terms, to the extent they relate to them.
2. Using the App
- 2.1You must register using accurate personal information. Sign-in is by OTP or any other method RSC may introduce. You are responsible for keeping your login credentials confidential and for all activity under your account and must inform RSC immediately if you become aware of any unauthorised access or use. RSC is not liable for any loss arising from your failure to safeguard your credentials.
- 2.2If you choose to sign in with Face ID, fingerprint or another biometric method on your device, this is handled by your device’s operating system and is separate from Facial Recognition (“FR”) under clause 6. RSC does not receive or store that biometric data.
- 2.3RSC grants you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device as a Member. You shall not reverse-engineer or disassemble the App, use it for any unlawful purpose, use automated means to access it, resell or commercially exploit access to it, or interfere with its functioning or security.
- 2.4All content, trademarks (including the RSC name and logo), designs, software and other intellectual property in the App remain the exclusive property of RSC.
- 2.5RSC may release updates (which may be mandatory for continued use) and may add, change, suspend or withdraw App features, which may differ by Membership Plan, tier, Event or city. RSC does not guarantee that the App will be uninterrupted or error-free.
- 2.6The App may ask for permission to use device features such as the camera (for example, to register Face Data or scan QR codes), notifications, photos or files, contacts (for example, to add Guests) and, where enabled, location. Each permission is asked for separately and used only for the feature concerned, and you can change it in your device settings. If you decline, the related feature may not work.
- 2.7RSC may send push notifications, WhatsApp messages, SMS or emails about Events, Benefits and your account. Push notifications are sent only if you allow them on your device, and promotional messages only with your consent. Event listings, line-ups, dates, timings, venues and availability shown in the App come from organisers, Partners and other sources, are indicative only and may change without notice. Please check the latest information in the App or with the Concierge before making plans.
3. Memories and Support
- 3.1Content in Memories is for your personal, non-commercial use only. You shall not sell it, publish it publicly or use it for any commercial or promotional purpose, and you shall not post, share or tag any other person’s image without their consent. RSC, the organisers, artists, photographers and other rights holders keep all rights in it.
- 3.2Support is provided on a reasonable-efforts basis. Where the App opens an external link including WhatsApp with a pre-filled message or a Payment Gateway, it is a third-party service under its own terms, which RSC does not control.
4. Bookings
- 4.1You may submit a Booking Request through the App or through the Concierge for yourself, your Nominee, a saved Guest or a new Guest, along with any entry preferences and special requests. RSC may accept, vary or decline a Booking Request, having regard to availability, the attendee limit for the Event, the Member’s tier and the Member’s standing under the RSC Terms. Entry preferences and special requests are handled on a best-efforts basis and are not guaranteed.
- 4.2You must give complete and accurate details for every attendee, including names (as on a government ID, where the organizer requires it), contact details, the delivery address for a Physical Ticket/Band and the mobile number for an m-Ticket. RSC is not responsible if entry is refused, or a ticket is lost or reaches the wrong person, because of incorrect details you provide.
- 4.3When you add a Nominee or Guest to a booking, you confirm that you are authorised to share their details with RSC, that they know their personal data will be used for the booking and Event entry (including FR, if they choose it), and that they agree to attend on the RSC Terms and these App Terms.
5. Event Access Methods
- 5.1Entry to an Event is enabled through the Access Method(s) decided by RSC, the organiser or the venue and shown in your booking details. RSC may change or add to them, including by manual checks, for operational or security reasons. An Access Method is personal to the named attendee and must not be shared, copied, sold or transferred. RSC or the organiser may deactivate any Access Method it reasonably suspects is being misused, and may refuse entry to anyone without a valid Access Method.
- 5.2The Physical Ticket/Band is delivered to the address you provide. You must give a complete and accurate address and contact number in time; changes after dispatch may not be possible. RSC will make reasonable efforts to dispatch in time but is not responsible for courier delay, loss or damage, or for non-delivery caused by an incorrect address or your unavailability. A replacement is possible only if the organiser permits and may be charged for. A tampered, duplicated or resold item may be treated as invalid without refund.
- 5.3The m-Ticket is transferred to the mobile number you provide on the BookMyShow app, and entry is by showing it there. You need a BookMyShow account linked to that number. RSC is not responsible if the ticket is transferred to a wrong or inactive number you provided, or for any outage, error or delay in the BookMyShow app, which is operated by BMS under its own terms. A transfer once made may not be reversible.
- 5.4If an Access Method does not work at an Event, contact the RSC team or the organiser’s help desk at the venue. RSC will make reasonable efforts to assist, but entry remains at the discretion of the organiser and venue.
6. Facial Recognition and Face Data
- 6.1At certain Events selected by RSC, RSC may offer FR entry, operated through a Turnstile Provider. FR is entirely optional. Declining it does not, by itself, prevent a Member, Nominee or Guest from attending an Event; where FR is not used or not consented to, entry is managed through the standard means for that Event.
- 6.2If a Member, Nominee or Guest consents, their Face Data is captured and registered through the App (or a web link shared by RSC for the purpose) and is used only for FR at the Event(s) they have consented to. It is shared with the relevant Turnstile Provider only to enable automated entry verification at those Event(s). Consent is asked for separately for each relevant booking or Event and does not extend to any other Event or purpose.
- 6.3Face Data registration for an Event is automatically revoked when that Event ends. RSC may keep a record of your consent and its revocation (without the Face Data itself) for as long as applicable law requires. For any later Event you will need to give fresh consent.
- 6.4A Member must not register the Face Data or other personal data of a person under eighteen (18) years of age through the App. The only exception is FR entry at select Events, which may be done for such a person only with the valid consent of their parent or lawful guardian.
- 6.5A Member who registers or re-registers the Face Data of a Nominee or Guest confirms that the person is aware of it and has consented to it. A Nominee or Guest may withdraw consent at any time under clause 6.7, whether or not the Member agrees.
- 6.6Face Data is personal data. RSC will process it in accordance with clause 7 (Personal Data and Data Protection Law), other applicable law and clause 14 (Privacy and Data Protection) of the RSC Terms.
- 6.7A Member, Nominee or Guest may withdraw consent to future use of their Face Data at any time by writing to RSC at the email address given under clause 9 (Contact Us). RSC will give effect to the withdrawal within a reasonable time and delete the Face Data as stated in clause 6.3. Withdrawal does not affect processing carried out before it and may require the person to use standard, non-FR entry at future Events.
- 6.8RSC does not guarantee FR entry at any Event and may use alternative or additional verification, including manual identity checks. RSC is not liable for any malfunction, delay or entry issue caused by the Turnstile Provider’s systems. Standard entry remains available as a fallback wherever the venue or organiser offers it.
7. Personal Data and Data Protection Law
- 7.1Until the DPDPA Effective Date, RSC will collect and process personal data (including Face Data) in accordance with the Information Technology Act, 2000 and other applicable law then in force. “DPDPA Effective Date” means the date on which the substantive provisions of the Digital Personal Data Protection Act, 2023 (“DPDPA”) and the rules made under it (including those on notice, consent and the rights of Data Principals) come into force.
- 7.2RSC will inform you, before or at the time it collects your personal data (including at registration/onboarding), what data is collected, why, who it is shared with, how long it is kept, how to withdraw consent and how to contact RSC with a grievance. Face Data and any other sensitive data are collected only on your separate, specific and express consent. This consent is not bundled with acceptance of these App Terms and is not a condition for using App features that do not need that data. RSC will keep a record of every consent and withdrawal.
- 7.3 From the DPDPA Effective Date, the following apply automatically, without any further notice or act, and prevail over anything inconsistent in the RSC Terms or these App Terms, and the earlier law referred to in clause 7.1 will cease to apply to the extent the DPDPA replaces it:
- (a)RSC will act as a Data Fiduciary and will process personal data only with your free, specific, informed, unconditional and unambiguous consent, or for another purpose the DPDPA permits. RSC will give you a plain-language notice, itemising the data and purpose, with each consent request, and in English or any language in the Eighth Schedule to the Constitution on request.
- (b)RSC will process only the data needed for the stated purpose, will keep it accurate and will erase it when you withdraw consent or when the purpose is served, unless the law requires RSC to retain it. Withdrawing consent will be as easy as giving it.
- (c)You may ask RSC for a summary of your personal data and the individuals it has been shared with, and for its correction, completion, updating or erasure. You may also nominate another person to exercise your rights if you die or become incapacitated.
- (d)RSC will use reasonable security safeguards, and will report any personal data breach to the Data Protection Board of India and to affected persons as the DPDPA requires.
- (e)Before processing the personal data of a person under eighteen (18) years of age, including Face Data under clause 6.4, RSC will obtain verifiable consent of the parent or lawful guardian. RSC will not track or monitor the behaviour of, or target advertising at, such a person.
- (f)You may raise a grievance with RSC at the contact details under clause 9 (Contact Us) and, if it is not resolved, may complain to the Data Protection Board of India.
- (g)You must give accurate information, must not impersonate anyone or register another person’s data without their authority, and must not make false or frivolous complaints.
- (a)
- 7.4Existing consents. Consent you gave before the DPDPA Effective Date remains valid. As soon as reasonably practicable after that date, RSC will give you a notice that meets clause 7.3, and you may withdraw consent at any time.
- 7.5Nominees and Guests. A Nominee or Guest is a Data Principal in their own right. Their consent is taken separately, and they may exercise all rights under this clause 7 and clause 6 directly with RSC, whether or not the Member agrees. This does not limit the Member’s confirmations under clauses 4.3 and 6.5.
